THIS SECTION LIMITS BHOOMIDA’S LIABILITY TO YOU FOR ISSUES THAT MAY ARISE IN CONNECTION WITH YOUR USE OF BHOOMIDA WEBSITE / APPS. IF YOU DO NOT UNDERSTAND THE TERMS IN THIS SECTION OR ELSEWHERE IN THE AGREEMENT, PLEASE CONSULT A LAWYER FOR CLARIFICATION BEFORE ACCESSING OR USING THIS WEBSITE. An online marketplace ecosystem that offers its users a plethora of services on a single platform. Enjoy shopping for clothes, accessories, cosmetics, footwear, jewelry, handicrafts, grocery, fresh fruits, vegetables and many more. Register as a seller to enjoy ease of doing business as a wholesaler or a retailer. Also enjoy never before experience of different types of services in the same app! Bhoomida website (“Bhoomida.com”) and the mobile application (“Bhoomida”) and subsequent apps, collectively referred to as Platform is owned, managed and operated by Bhoomida Private Limited company and their associates, affiliates, technology partners and associated service providers referred to as Bhoomida/Company, incorporated under the Companies Act, 2013 (18 of 2013) and rule 18 of the Companies (Incorporation) Rules, 2014. Bhoomida is an ecommerce platform consisting of many sub-apps that enables sale and purchase of goods & services by vendors and customers. Bhoomida only provides the medium i.e. the platform, to be used by buyers, sellers, vendors, wholesalers to carry out the transaction of buying & selling of products/goods & services. Bhoomida does not sell or buy goods/services for self or anyone or any company/shop. Bhoomida does not endorse any brand, shop, product/service or any particular entity. Bhoomida does not allow sale of illegal / unethical goods or services. The vendors (sellers/retailers) are responsible for the goods / services, description, other details and photos that are put up on the platform to be sold. Registered office at 8, HB Estate, Sonegaon Lake, Nagpur - 440025, Maharashtra. Bhoomida Private Limited group of companies, sister companies, subsidiaries, associates, affiliates, NGOs, vendors, suppliers, service partners and providers and other third parties are collectively referred to as Other Parties. We welcome you all to use our platform to enable ease of doing business and shopping a fulfilling experience. Hope you enjoy using Bhoomida platform, made in India! Please read the terms & conditions, privacy policy and all other policies carefully. The policies may not be exhaustive and will be updated / changed from time to time. Users will be notified about the change and the new policies will be pushed into implementation from the effective date. Terms and conditions for the use of the platform 1. Anyone (user/person), who downloads, installs, accesses and/or uses the Bhoomida Platform/app(s)/website in any manner is subject to these terms and conditions and bound by the same. 2. These terms and conditions constitute a legally binding agreement between the user and Bhoomida Private Limited. You are requested to read these Terms & Conditions carefully before accessing or using the Platform and accepting them before using the Platform. 3. Bhoomida may update/modify/amend these Terms (including any part of it) at any time, with or without advance notice. Users are expected to keep up with the new changes and if they do not agree, they should immediately stop using the app, services and website. 4. Accessing/using the Platform/Services constitute your consent to the Terms. By using the Platform/services, you/user acknowledges the acceptance of these Terms and agrees to be legally bound by them. If at any time, you/user do not agree to be bound by these Terms, you/user may not access/use the Platform/services. These Terms supersede all previous terms and conditions. The use of the Platform/services and all rights and liabilities of Bhoomida will be limited to the scope of these Terms. Bhoomida reserves the right, without any prior intimation/notice, to restrict access to the app/website or use of its services or any features, subject to conditions that Bhoomida may deem proper in its discretion. 5. This document is in accordance with the Information Technology Act, 2000 (“IT Act”) and rules made thereunder as may be applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signatures. 6. In addition to these Terms, users are required to adhere to the terms and conditions of the third parties/vendors, which will be mentioned on the Terms & Conditions section of their e-shop/product information. It is hereby clarified that Bhoomida shall not be held liable/responsible for any transaction carried between the User and any such third parties/vendors. 7. As a user of the platform, you agree to not misuse, abuse the platform in any way, and state false / misleading / inaccurate/ inappropriate / unlawful information on the platform. The Platform cannot be used for any harmful activity or for harassing / threatening, relating to money laundering or gambling or any unlawful activity, or impersonating any person or firm/company. You cannot post/upload any information / picture / video which does not belong to you and which is indecent, objectionable, vulgar, obscene, defamatory, pornographic, paedophilic, gory, sacrilegious, profane, in violation of anyone’s privacy, hateful, racial, derogatory, or anything that causes physical/psycological harm, or anything that objectifies women/minors. 8. Users agree to not use Bhoomida platform to - Sell, offer, conduct any kind of business directly or indirectly, with the fellow vendors after acquiring their information. All business dealing will happen through Bhoomida platform. transmit any kind of coded messages, junk messages, spam messages, personal messages, instructional messages or any other kind of unsolicited messages. make use of, promote any illegal/unauthorized copyrighted work by providing links or files of websites/URLs, software, code, viruses, music, movies, photos, videos, any digital content, etc. violate any third party's right to ownership of property, right to patent, right to goodwill, privacy rights, intellectual property rights and any copyright / patent / trademark or any other rights. try to illegally access Bhoomida platform or any part of the platform, or server or database/files, or any other sub-systems or networks of Bhoomida, or any network or computer on that network, or any of the services offered, or accounts by any means. sell fraudulent, inferior, wrong, used (unless clearly mentioned in the product description), scam, counterfeit, smuggled, stolen products or services, illegal contraband. conducting any promotions/sales/discount offers/advertising without prior intimation and getting legal consent from Bhoomida. acquire forceful or unauthorized access to the Platform / apps / vendors / third parties / account for personal / commercial / unlawful purposes. by any means, get access, hack, obtain, duplicate, scan, test, record, track any part/feature of the Bhoomida platform for any purpose. to do any activity or state any information that jeopardizes the honesty and honor of Bhoomida, any step/practice/information/content that threatens the peace, pride, unity, security of the country. We take pride in saying that the app is made with pure love and labor and is made in India. violate any current enforced applicable law. 9. Once you/user registers on our Platform, the same credentials can be used across the platform for the usage of other services provided by the Platform. Other apps or services may be accessed/used by downloading & installing independent apps or they could be part of the single Bhoomida platform. 10. You can enjoy the platform by installing the app or accessing the website free of cost. There are no charges for retail users. Data/internet charges will apply for downloading and installing the app, email notifications and SMS charges will apply for OTP verification and future SMS notifications (charges applicable as per service providers). 11. Users can unsubscribe / opt out from the notifications (in-app notifications, SMS, Email, any other communication) sent by Bhoomida Platform / apps at any time by following the procedure i.e. clicking unsubscribe from the email, sending STOP from SMS, setting the notifications option to off from the app. 12. Users can discontinue the use of the app / platform / services at any time. By discontinuing the use, the user would still be required to pay for any product / service for which he has placed an order from the app/platform prior to discontinuation. 13. Bhoomida company and its app/website does not operate outside India. Users operating the app / website from outside India are doing so at their own risk and Bhoomida is not liable / responsible for content / transaction / deal / promotions / sale happening outside India. These Terms & Conditions and other policies may be modified from time to time, and apply to all visitors, guest buyers, users of the app and the website. All Users are required to read these and if they do not agree with it then stop using the website/app and its services. User registration - At the time of registration, users must be 18 years of age or above or in case of minors with guardian’s permission. Registration is a one-time process and is free of any charges. Users must register on Bhoomida platform to enjoy all the Services. Guest users can only browse the products. A user will have one registered account under his/her name by providing the phone number, which will be verified by OTP. Bhoomida has the right to cancel any account if - the same user has registered for more than one account. the information provided by the user is suspicious or incorrect. Bhoomida finds any other reason that does not deem fit for the platform/company and can do so without stating any reason. If T&C and PP are violated. If directed by government / legal authorities. User has to do registration by providing a password and all necessary and valid information required to complete the profile. Like - complete name, phone number, address, email, gender, gps location, DOB etc. In addition users registering as sellers have to provide GSTIN, PAN/TIN, Bank account number, Udyam Aadhar, etc. Users should not share their password with anyone and are solely responsible for its maintenance. Users will be completely responsible for all the transactions and activities happening in their account. Accepting the Terms & Conditions, Privacy Policy and other policies are part of the registration process. If you do not agree with the policies, you cannot use the platform. Payment options - For your/users ease and convenience, Bhoomida provides multiple payment options to its users. Bhoomida reserves right to make changes to these payment options by adding or deleting any payment options from the list below, without prior notice - Debit card Credit card Net banking UPI Cash on Delivery Important points to be considered while using these payment options - All the cards/payment methods accepted by payment gateway channel partners should be used and users must be authorized / allowed to conduct financial transactions in India. Users must use cards that they own and not somebody else. If required such transactions would be shared with the legal team. Bhoomida reserves the exclusive right to reject any payment options for any reason deemed proper by Bhoomida. Few transactions might need user authentication, for which additional documentation would be required like Aadhar / PAN. Failing to provide such information would result in rejection of the payment option chosen by the user. User is required to provide accurate and complete information about the payment option chosen. This information may be stored by the third party payment gateway providers, with user consent. Bhoomida is not responsible / liable for any unauthorized use of the financial information of the user. Users are responsible for the security of their own information. Bhoomida is not responsible / liable for any kind of loss to the user due to the transaction being unsuccessful. Bhoomida is not responsible / liable for the misuse of their provided financial information due to their mistake. Bhoomida is not responsible / liable for any failed transaction occurring due to technical glitches / power failure / any other reasons. Bhoomida is not responsible / liable for insufficient funds or if their card limit exceeds. On using a credit card as payment option, the user is responsible for paying towards the credit card bill. Bhoomida reserves the right to cancel / delay any transaction if - Bhoomida finds any transaction objectionable, suspicious, if the user crosses any limit of transaction that Bhoomida deems inappropriate. Bhoomida will not be responsible / liable for any delay, damage, inconvenience due to Bhoomida canceling the transaction. A vendor is responsible for the display of product/service price on the Bhoomida platform / app and may or may not include the taxes (GST, ST, VAT, CST, shipping/delivery charges, packaging charges, service charge), the total amount payable including the applicable taxes/charges will be displayed on the checkout page. If the user purchases any goods/services, he/she agrees and is responsible for the payment of the entire amount for that purchase. Bhoomida has no responsibility / liability towards the pricing of product/service. Bhoomida levies a certain charge on the transaction / product / service, which the user agrees to pay. This platform service charge will be the part of the billing amount displayed on the checkout page. Vendor is solely responsible for the pricing, product/service information, quality and other factors related to the product / service that vendor offers on the platform. Bhoomida is not responsible/liable for any of the misinformation, discrepancies, errors that might occur due to vendor’s oversight, technical glitch or any other reason. Shipping cost will be provided by the shipping channel partner and will be included in the invoice. For any charge that the user feels is unauthorized and not made by her/him, they should first cross verify with their family members, friends, associates or with those they might have shared their banking/cards/payment details. If still the user feels that the purchase is not done by them, they should contact Bhoomida within 7 days from the date of unauthorized purchase to carry out investigation. If the investigation results in the confirmation that the purchase is unauthorized, the user/customer will be informed about the same. Bhoomida is not responsible for any kind of refund or compensation to the user/customer. Users allow Bhoomida / payment aggregators to debit their bank account / card or other payment options when they purchase on Bhoomida platform and credit when they return any product. Cash / Payment on delivery will be available as per vendor, payment channel partner and delivery channel partner service availability. For vendors giving COD payment option, platform charges will be settled through a separate invoice to the vendor. If you are an end user/retail buyer - The above mentioned terms & conditions, privacy policy and all the other policies apply to you. You can register on the app/website by providing your information, which will be verified by OTP. 1. Return, refund & exchange policy - The user will have to abide by the return & exchange policy of the shop/vendor/retailer/wholesaler from where the product/service is purchased. The Company is not responsible/liable or dictate any of these terms. Users are encouraged to shoot the video of unpackaging of the product for ease of the return process. 2. You are advised to read all third parties' terms and conditions and privacy policies before using the Bhoomida platform. You accept and acknowledge that Bhoomida does not govern such third parties' apps/websites/products/services and shall not be responsible or liable for these or to anyone. 3. Payment information & transfer - The payment details like bank account, credit card, debit card or other payment details will be collected by the Company and the third party payment gateway provider in accordance with the law to carry out the financial transaction. The vendor from whom the product/service is purchased will not have access to this information. The payment amount will be credited to the vendor's account 7 working days after the delivery of product /service availed or after the return/exchange buffer has passed (whichever is more). Similarly after successful return of the product, the amount will be credited to the user, as per their choice of medium, after 7 working days from the date of return. 4. Delivery and shipping details - The third party delivery partner and the vendor will have the information about delivery and shipping. The user will be updated from time to time about the timeline of the delivery schedule. In case the product is lost in transmission, or damaged, of inferior quality the user agrees that Bhoomida is not liable/responsible for the loss. 5. Rating and feedback - You/User agrees to submit reviews specific to the products and services purchased through Bhoomida. You/user gives complete, unquestionable, irrevocable, undisputable, non-remunerable, non-claimable authority to Bhoomida, to copy, reproduce, publish, display, transmit, distribute, duplicate, edit, change, adapt, update, modify, translate/transform, imitate, advertise and otherwise use any or all of the user uploaded content in any format/form, media, or technology known/unknown in any manner and for any purpose which may be benefectory to the operations of the Bhoomida platform, when they upload/post any information/pictures/videos/rating. Users agree that they have acquired the right to upload any image, photo, video, name, text, if the content is copyrighted. 6. Bhoomida will not be responsible or held liable for any lapse/disconnect in information and quality regarding the services/business/shop/products. 7. Users understand and agree that purchase of products and services is at their own risk and responsibility. Bhoomida is not in any way responsible / liable for the goods and services brought on the Platform. 8. Please check our other policies. If you are a retail vendor - The above mentioned terms & conditions, privacy policy and all the other policies apply to you. . You can register on the app/website by providing your information, which will be verified by OTP. Following are the terms & conditions for the retail vendors. You agree to the privacy policy, terms and conditions mentioned under User Registration above and the following. To sell on Bhoomida, vendors have to send a request to the company to be registered as verified sellers (retail, wholesale). You have to provide your business/shop name, owner’s name, shop address, phone number, email address, type of business, products offered, catalog/photos of the product, GSTIN number, Udyam Aadhar, PAN, TIN, etc to get verified as a legal business entity and then get registered as sellers on Bhoomida platform. Once approved, you will be onboarded and have special login privileges. We will help you set up your online shop on Bhoomida app/website, you may be provided with a Point Of Sale (POS) system (additional service provided by Bhoomida) for your shop. This hassle free system will help you maintain your inventory online, local/offline sale and can be operated through your personal devices. Seller is responsible for all the content (photos/text information/business related information/catalogs/videos) they post and ensure that they have gathered all necessary permission and licenses. The content should not violate any copyright, trade marks/names, anyone's privacy, patents. Bhoomida is not liable for any copyright, IP violation because of digital contents provided by users. Seller agrees to use the Bhoomida platform strictly for business purposes. Bhoomida reserves total rights to terminate any seller/business/shop account. Seller is completely responsible for the authenticity of the information provided about their business & products. The information provided should be accurate and complete and should be updated from time to time if there are any changes. Bhoomida will not be responsible or held liable for any lapse/disconnect in information regarding the business/shop/products/services. Seller agrees and permits Bhoomida to use all the information provided to be stored and used by Bhoomida and use the contact information provided to communicate for any information/offer/business deal/notices etc. Return, refund & exchange policy - As a retailer you will set up your own policy for return, refund & exchange for the retail buyers/end user. The user will have to abide by the return & exchange policy of the shop/vendor/retailer/wholesaler from where the product/service is purchased. The Company is not responsible/liable or dictate any of these terms. When you buy from the wholesalers, you will have to abide by their return, refund & exchange policy. Third party terms and conditions - You have to follow the terms and conditions of the wholesale vendor. Payment information & transfer - The payment details like bank account, credit card, debit card or other payment details will be collected by the Company and the third party payment gateway provider in accordance with the law to carry out the financial transaction. The vendor from whom the product/service is purchased will not have access to this information. The payment amount will be credited to the vendor's account 7 working days after the delivery of product /service availed or after the return/exchange buffer has passed (whichever is more). Delivery and shipping details - The third party delivery partner and the vendor will have the information about delivery and shipping. The user/buyer will be updated from time to time about the timeline of the delivery schedule. In case the product is lost in transmission, or damaged, of inferior quality the user agrees that Bhoomida is not liable/responsible for the loss. Vendor agrees to bear the cost for any damaged products, pilferage, inferior quality of product, wrong product. As per applicable laws, taxes (GST, TDS, etc) will be collected at source based on invoice amount and will be deposited to respective government agencies accordingly. As per the law electronic invoice generation is mandatory. Please refer to our Product Listing Policy here. If you are a wholesale buyer / seller - The above mentioned terms & conditions, privacy policy and all the other policies apply to you. You can register on the app/website by providing your information, which will be verified by OTP. Above mentioned terms for retail vendors also applicable to you. Following are the terms & conditions for the wholesale buyers / sellers. You agree to the privacy policy, terms and conditions mentioned under User Registration above and the following. To sell and buy wholesale on Bhoomida platform, you have to send a request to the company to be registered as a verified wholesale buyer/seller. You have to provide your business/shop name, owner’s name, shop address, phone number, email address, type of business, products offered, catalog/photos of the product, GSTIN number, Udyam aadhar, PAN/TIN etc to get verified as a legal business entity and then get registered as a wholesale buyer/seller on Bhoomida platform. Once approved, you will be onboarded and have special login privileges on subscription basis. We will help you set up your online shop on Bhoomida app/website, you may be provided with a Point Of Sale (POS) system for your shop. This hassle free system will help you maintain your inventory online and can be operated through your personal devices. You are responsible for all the content (photos/text information/business related information/catalogs/videos) they post and ensure that they have gathered all necessary permission and licenses. The content should not violate any copyright, trade marks/names, anyone's privacy, patents. Bhoomida is not liable for any copyright, IP violation because of digital contents provided by users. You agree to use the Bhoomida platform strictly for business purposes. Bhoomida reserves total rights to terminate any account/business/shop on the platform. You are completely responsible for the authenticity of the information provided about your business & products. The information provided should be accurate and complete and should be updated from time to time if there are any changes. Bhoomida will not be responsible or held liable for any lapse/disconnect in information regarding the business/shop/products. You agree and permit Bhoomida to use all the information provided by you to be stored and used by Bhoomida and use the contact information provided to communicate for any information/offer/business deal/notices etc. Return, refund & exchange policy - As a wholesaler (wholesale seller) you will set up your own policy for return, refund & exchange for the retail buyers/other wholesale buyers. The buyer will have to abide by the return & exchange policy of the wholesaler from where the product/service is purchased. The Company is not responsible/liable or dictate any of these terms. When you buy from the wholesalers, you will have to abide by their return, refund & exchange policy. Third party terms and conditions - You have to follow the terms and conditions of the wholesale vendor / other manufacturing companies. Subscription information - Wholesale buyer and seller will be charged a nominal subscription fees to be able to do business on Bhoomida platform. Bhoomida can increase this fee as when required without prior intimation. Payment information & transfer - The payment details like bank account, credit card, debit card or other payment details will be collected by the Company and the third party payment gateway provider in accordance with the law to carry out the financial transaction. The vendor from whom the product/service is purchased will not have access to this information. The payment amount will be credited to the vendor's account 7 working days after the delivery of products /services availed or after the return/exchange buffer has passed (whichever is more). Delivery and shipping details - The third party delivery partner and the vendor will have the information about delivery and shipping. The user/buyer will be updated from time to time about the timeline of the delivery schedule. In case the product is lost in transmission, or damaged, of inferior quality the user agrees that Bhoomida is not liable/responsible for the loss. As per applicable laws, taxes (GST, TDS, etc) will be collected at source based on invoice amount and will be deposited to respective government agencies accordingly. If you are a service vendor - The above mentioned terms & conditions, privacy policy and all the other policies apply to you. You can register on the app/website by providing your information, which will be verified by OTP. Following are the terms & conditions for the Service vendors: To sell your services on Bhoomida, you have to send a request to the company to be registered as a verified service vendor. You have to provide your business/shop name, owner’s name, shop address, phone number, email address, type of business, services offered, catalog/photos, GSTIN number, Udyam aadhar, PAN/TIN, etc to get verified as a legal business entity and then get registered as service provider on Bhoomida platform. Once approved, you will be onboarded and have special login privileges on a regular/premium subscription basis. We will help you set up your online shop on Bhoomida app/website, you may be provided with a Point Of Sale (POS) system for your shop. This hassle free system will help you maintain your service catalog online and can be operated through your personal devices. You are responsible for all the content (photos/text information/business related information/catalogs/videos) you post and ensure that you have gathered all necessary permission and licenses. The content should not violate any copyright, trade marks/names, anyone's privacy, patents. You agree to use the Bhoomida platform strictly for business purposes. Bhoomida reserves total rights to terminate any seller/business/shop/service account on the platform. You are completely responsible for the authenticity of the information provided about your services, business & products. The information provided should be accurate and complete and should be updated from time to time if there are any changes. Bhoomida will not be responsible or held liable for any lapse/disconnect in information regarding the services/business/shop/products. You agree and permit Bhoomida to use all the information provided to be stored and used by Bhoomida and use the contact information provided to communicate for any information/offer/business deal/notices etc. Return, refund & exchange policy - As a service provider, you will set up your own policy for return, refund & exchange (whichever is applicable) for the customer/end user. The user will have to abide by the return & exchange policy of the service vendor. The Company is not responsible/liable or dictate any of these terms. Third party terms and conditions - You have to follow the terms and conditions of the third party vendors. All service vendors will be charged a nominal subscription fees to be able to do business on Bhoomida platform. Bhoomida can increase this fee as and when required without prior intimation. Payment information & transfer - The payment details like bank account, credit card, debit card or other payment details will be collected by the Company and the third party payment gateway provider in accordance with the law and with user consent to carry out the financial transaction. The vendor from whom the product/service is purchased will not have access to this information. The payment amount will be credited to the service vendor's account 7 days after the service is availed or after the return/exchange buffer period (as applicable) has passed (whichever is more). Delivery and shipping details - The third party delivery partner and the vendor will have the information about delivery and shipping. The user/buyer will be updated from time to time about the timeline of the delivery schedule. In case the product is lost in transmission, or damaged, of inferior quality the user agrees that Bhoomida is not liable/responsible for the loss. As per applicable laws, taxes (GST, TDS, etc) will be collected at source based on invoice amount and will be deposited to respective government agencies accordingly. Reviews - For users to rate the product / services and submit reviews, they must have purchased the product / service for themselves or their family members / friends. Review & rate products / service features will be enabled only for verified purchasers. Users are expected to be honest while rating and reviewing the products and services. While posting the reviews, users must abstain from profane language and indecent photos/videos. Users must not provide any information that is not related to the review of the product. Bhoomida has the right to remove any reviews and photos/videos. Legal action will be taken against users who participate in fake reviews. Products & Services Listing policy - Please refer to our Products & Services Listing policy here. Jurisdiction and governing law - This User Agreement / Terms & Conditions is in accordance with the applicable laws of India. The honorable Courts at Nagpur, Maharashtra shall have exclusive jurisdiction in all types of proceedings arising out of this agreement, which shall be in accordance with the Arbitration and Conciliation Act, 1996. The honorable Court of Nagpur alone shall have the jurisdiction and the Laws of India shall be applied. In case of any disagreement / difference / disputation / variance arising in understanding / interpretation or otherwise of the Terms & Conditions and Privacy Policy between the users/parties, a legal team will be appointed by Bhoomida Pvt Ltd and their decision will be final and binding on the parties. General terms - You may not post any content or sell any item/service on the Platform that is restricted or prohibited by a national, state or local law in India. Posting any content or listing any item/service below are specifically prohibited unless expressly permitted in writing by Bhoomida. HOWEVER, THIS LIST IS NOT INTENDED TO BE EXHAUSTIVE AND MERELY INDICATIVE. Posting of items/services which may not be restricted or prohibited by law but are nonetheless controversial including: i. Items that encourage illegal activities and are illegal (e.g. lock pick tools, synthetic urine for cheating drug tests, contraband); ii. Items that are racially, religiously or ethnically derogatory, or that promote hatred, violence, racial or religious intolerance; iii. Giveaways, lotteries, raffles, or contests; iv. Pornographic materials or items that are sexual in nature; v. Massage parlours Bhoomida reserves the right to impose additional restrictions and prohibitions at any time. There are some police items that may be listed on the Bhoomida provided they observe the following guidelines: i. Authorised general souvenir items that do not resemble badges, and paperweights that do not contain badges. ii. Badges that are clearly not genuine or official. iii. Historical badges that do not resemble modern law enforcement badges, provided that the item description clearly states that the badge is a historical piece. iv. Any official, internal, classified or non-public documents. v. Any service, instruction, process, or aid for producing any biological, chemical, or nuclear weapons, or other Weapons of Mass Destruction (WMD) or known associated agents. Items depicting or suggestive of bestiality, rape sex, incest or sex with graphic violence or degradation, and any items depicting or suggestive of sex involving minors or otherwise, are strictly prohibited. 6. Circumvention devices and other equipment used for illicit purpose Descramblers and other items that can be used to gain unauthorised access to television programming (such as satellite and cable TV), internet access, telephone, data or other protected, restricted, or premium services. Devices designed to intentionally block, jam or interfere with authorised radio communications, such as cellular and personal communication services, police radar, global positioning systems (GPS) and wireless networking services (Wi-Fi). The listing or sale of spy equipment and devices used for interception of wire, oral and electronic communications. Bank card readers and “skimmers”. Reproductions or replicas of coins as collectible items must be clearly marked with the word "COPY", "REPRODUCTION" or "REPLICA" and comply with local laws. Artefacts, cultural relics, historical grave markers, and related items are protected under the laws of India. 10. Human body parts, remains and protected flora and fauna Listing of human body parts and remains. Bhoomida is not responsible for any return and refund of products sold by vendors. Please refer to Cancellation, Return and Refund policies defined by the vendor. The vendor's cancellation, return and refund policy supersedes Bhoomida’s cancellation, return and refund policy. If the vendor is accepting returns and no explicit cancellation, return and refund policy is provided by the vendor then following are the set guidelines that can be referred for procedural explanation. This policy states Bhoomida’s effort of ensuring user satisfaction with cancellation, return and refund policy and procedure of handling product cancellations before the product is delivered to the user, product returns and refund which is governed by and subject to the terms and conditions below. Users are requested to read and understand the terms of this policy. If you do not agree to the terms contained in policy, you are advised not to accept the Terms of Use and stop using the App/Platform. The terms contained in this policy shall be accepted as is and you agree to be bound by the terms contained herein by initiating a request for purchase/sale of products/services on the App/Platform. It is to be adhered that products may be returned only in case of defects or damages in the products, incorrect products shipped to the user, missing components and empty sealed packages and not for any other reason. 1.Cancellation of order before dispatch and refund a.Users are allowed to partially or fully cancel orders before it is dispatched from the vendor. b.Upon successfully placing an order on the App and after the vendor has successfully dispatched the ordered product(s) to its Delivery Partner, the user will receive a unique tracking number which will enable the user to track the status of delivery of the purchased products. c.If the user decides to cancel the purchase prior to the dispatch of the purchased products, the user can refer to the order history section of the app, click on the purchased order and click cancel button. The order will be canceled, a cancellation email will be sent to your email id and after deducting third party payment gateway fees (if applicable), the remaining amount will be refunded to your payment mode used within 7 business days. d.In case of cash on delivery, as no financial transaction is conducted while placing the order, there will be no refund. e.In case of any coupons or promo code used for the payment, the amount refunded will comprise the full amount paid by the user. The discounted amount will not be refunded. f.After the order is dispatched, the user cannot cancel the orders. g.The vendor can cancel the order if for any reason he is not able to fulfill the order.  2. Return of order and refund The return and refund is categorized based on the product category. The details and terms are stated below which shall apply and they are also subject to the other terms and conditions of this policy. Users are requested to read these carefully and understand the cases under which returns will be accepted. All product pages will display the product specific return information, subject to the vendor’s terms and conditions for returns and if he has uploaded the return specific information a.Users are allowed to partially or fully return orders after they have been delivered. b.The return process should be initiated within 7 days from the date of the product delivery or as defined by vendor’s return policy whichever comes first. c.They can do so by going to the order history page and clicking on the return button and following along the subsequent process to complete the return process. d.The return order process will be initiated and an email will be sent to your email id about the same. e.The product(s) should be returned in original packaging, should be unused, not damaged and with original tags intact.  f.To pick up the return order, a third party shipping personnel will come to the address where the order was delivered. g.Once the vendor acknowledges the returned products and verifies for the originality of the products and tags, the refund process will initiate in 3-4 business days and the refund amount will be credited to original payment mode in 7-10 business days. h.The refund amount will be credited to the original payment mode of the user and the amount will be calculated after deducting the shipping (if applicable), the platform fee and other charges levied by the bank, third party payment aggregator. i.In case of cash on delivery, the refund will be handled by the vendor directly. j.In case of any coupons or promo code used for the payment, the amount refunded will comprise only the actual amount paid by the user after deducting the shipping charge, platform fees and payment gateway fee / other third party fees. The discounted amount will not be refunded. Please refer to the table below for product category wise return period and also the products that cannot be returned or exchanged.

In case of certain products, including but not limited to accessories (watches) or precious jewelry / materials, a refund will be made once the relevant product reaches the store / brand showroom / warehouse and the quality check and entirety of the product is completed. If the user loses any certificate or part relating to said product, a fee / amount deemed fit by the seller shall be collected from such user. Users are requested to take note of the following before canceling / returning the products / order - 1. The user shall ensure that the product(s) being returned are in the condition as when they were delivered, with tags intact, unused, without any odor or fragrance, unwashed, without sweat and blood or any other stains and packaging material least damaged with labels. 2. Bhoomida reserves the right to change / update / alter / enforce this policy at any time without having to inform the user. Any changes in the policy will be notified to the users through means of push notifications or pop up box or by posting it on the app / platform. 3. If the user wants to return a product which was a part of a combo deal / package deal / promotional package, the user is required to return all the products and not just a part of the package deal to process refunds. 4. Vendor / Bhoomida will reserve the right to reject the return of the product and will not process any refund for return if : a. The product is used; fit, wearability and comfort check being exceptions. b. The product has any odor, scratch, dent, chipped, has been scented or has been washed. c. The product packaging, tags and additional accompanying accessories and gifts / coupons are damaged or missing or not returned with the product or used. d. The products unique number / barcode / serial number does not equal with Bhoomida’s records. e. The returned products are fake / counterfeit. f. The electronic items are returned without the plastic bag / bubble wrap, cardboard and silicone bags provided by Vendor / Bhoomida. g. The user in any way breaches the policy and Vendor / Bhoomida is convinced that the returned product is defective or cannot be used. 5. Bhoomida reserves the right to not issue a refund at its sole discretion and to - a. refuse to accept the return of such a product b. process any refund thereof c. deduct the amount payable in respect of such products from the amount of refund 6. Further, Bhoomida clarifies that the refund amount shall not include the amount paid for shipping charges, platform fees and other charges levied by the bank or third party payment aggregators. 7. The refund process shall be initiated once all the processes and quality checks are complied with and the vendor is satisfied. The refund shall be credited to the mode of payment the user chose while making the purchase / user’s bank account. 8 .The user shall be notified of the refund through the user's registered mobile number and email is i.e. SMS / email / app notification. However, Bhoomida is not liable for any glitch / failure / incorrectness of the refund status. 9. All the refunds shall be credited to the user’s original payment method / bank account. Once the amount is refunded to the user's original payment method, Bhoomida cannot further transfer the amount to any other bank account. 10. The usual time period for the refund process is 7 business days from the date the vendor receives the returned products. 11. All the cancellation and return timelines are subject to other unforeseen situations, like weather, pandemic, strike, riots, state level restrictions, any law in force, earthquake, act of god, etc. 12. Return of purchased products are facilitated through Bhoomida’s reverse-logistics partners wherever available. Upon a User making a request for return of product on the Bhoomida Platforms and the same being duly acknowledged by Vendor through Bhoomida platform, Bhoomida’s reverse-logistics partners shall get in touch with the user in order to collect the purchased products from the user and delivering it back to Vendor. While Bhoomida has made reasonable endeavors to ensure delivery and pick-ups across multiple locations in India, currently, Bhoomida has a select list of areas where deliveries and collection can be undertaken by its reverse-logistics partners. In events where Bhoomida is unable to facilitate a pick-up of the purchased product, return of such product will not be possible. Grievance Redressal - Any grievances relating to the Cancellation, Return and Refund policy may be directed to the grievance officer of Bhoomida at grievance.officer@Bhoomida.com.

Bhoomida platform for vendors consist of mobile app, website, digital consumption APIs and services under it. Bhoomida platform for vendors terms and conditions state the terms of use of the vendor app for all the retail and wholesale vendors and sellers. Please go through these terms and conditions and accept the terms. If you do not agree with the terms, you should stop using the app / Bhoomida platform. All vendors must register to sell products and services on Bhoomida platform for vendors. Vendors should provide all the necessary information for registration i.e. shop name, phone number, address, vendor name, shop license, GSTN, PAN, Udyam, active bank account number, IFSC code for respective bank account etc. Verified vendor tag is displayed adjacent to the shop name on the vendor app after the verification process is complete. The process includes the verification of license number, GSTN number, PAN, address and other necessary information. Once a vendor is registered they can start selling by uploading the product list / catalog / services offered. Vendors are required to diligently put all the information about all the products and services up for sale. Few mandatory fields are required like product / service name, maximum retail price, image, material / fabric details, expiry date (if applicable), weight, manufacturer and country of origin. We want to give the vendors the freedom to have their own cancellation, return and refund policy. So, while setting up your online shop on Bhoomida platform, please set up and upload your terms for shopping, cancellation, return and refund. The vendor’s cancellation, return and refund policy should be reasonable and acceptable by the customers and the vendor himself must abide by the policies. On receiving orders on Bhoomida app, vendor must act and update the required status of the order on the Bhoomida app and take actions necessary for the dispatch of orders. In case of cancellation or return, the vendor must act within the set number of days and process the refund as mentioned in the cancellation, return and refund policy. If the vendor wants to update or make changes to their cancellation, return and refund policy, they can do so by requesting Bhoomida for the changes. After reviewing the changes, Bhoomida will approve and the updates will reflect on the vendor policy section/page. In case the vendor is unable to provide with the cancellation, return and refund policy of its own, Bhoomida’s cancellation, return and refund policy will be applicable for that vendor and they are required to read and understand Bhoomida’s cancellation, return and refund policy and accept to start to sell on Bhoomida vendor app. At Bhoomida we hold high the user's requirement for quality goods and services, hence we urge all vendors to adhere to strict quality standards. Display / upload products and services that you are actually selling and delivering to customers. The products to be delivered to customers are expected to be new, unused, without any damage, stains, odor, expired. To reduce the cancellations and return of orders, vendors are expected to meet customers expectations for the products and services provided by the vendor. Vendors are strictly prohibited from selling fake, counterfeit, low quality, duplicate, expired products. Vendors must upload the photos and videos of the products and services that are clear, decent, of actual product and that does not violate the copyright. Please refer and adhere to the Bhoomida Products & Services Listing Policy. Vendors are responsible for providing a standard packaging for their products which is clean, easily disposable, protects the items / products from dust, liquid and proper cushioning for fragile items. Vendors can use their own shipping method i.e either deliver the products using a third party courier service or their own delivery associates. In case of inhouse delivery team / third party courier services from the vendor, verification, security and background check of the delivery personnel and delivery of orders is the responsibility of the vendor and Bhoomida is not liable for any issues, concerns, problems arising from the vendor delivery team / third party courier services. Bhoomida reserves the right to remove or cancel a vendor from Bhoomida app for any reason deemed right to Bhoomida, including but not limited to - by order of court of law or government authority consistent order cancellation and return too many negative reviews vendor breaching the terms and conditions / policies vendor dealing in business other than mentioned payment lapses any other reason that Bhoomida deems appropriate All vendors will be charged with a standard Bhoomida platform fee. The fee is not a fixed amount, but charged on a per transaction basis for sale price. So the vendor pays the platform fee only when he sells (irrespective of order cancellation / return). Additional Bhoomida services can be subscribed with prescribed subscription fees. Bhoomida platform maintenance charges will be levied on vendor per transaction basis and / or per month basis. The amount or funds will be deposited in the vendor's bank account after deducting the Bhoomida platform transaction fee after 7-10 business days or after the product return period is passed, whichever is more.
